- раздвоение или разветвление процесса. Ситуация, в которой определенные стадии разбирательства проводятся в различное время, как правило последовательно, реже (в больших процессах) параллельно, например, сперва разрешается вопрос о праве состава арбитража на рассмотрение соответствующего спора (см. jurisdiction of arbitral tribunal), а потом разрешается вопрос о существе исковых требований (merits), или когда сперва решается вопрос о наличии оснований для привлечения ответчика к ответственности, а потом устанавливается размер такой ответственности. Раздвоение процесса почти всегда влечет за собой затяжку времени до вынесения окончательного арбитражного решения, но в то же время может сэкономить деньги участникам процесса, если на один из принципиальных вопросов, изучаемых в начале разбирательства, дается негативный ответ, и тем самым отпадает необходимость в проведении слушаний по оставшимся вопросам.
