- участие ответчика в арбитражном разбирательстве без выдвижения возражений касательно его права на рассмотрение данного спора (jurisdiction of arbitral tribunal) и того, в каком порядке он был сформирован (constitution of arbitral tribunal). Представляет собой форму фиксации арбитражного соглашения, предусмотренную п. 2 ст. 7 Закона о МКА ("путем обмена исковым заявлением и отзывом на иск, в которых одна из сторон утверждает о наличии соглашения, а другая против этого не возражает"). Чтобы не утратить право на заявление возражений, связанных с компетенцией состава арбитража или его формированием, ответчик должен заявить такие возражения до своего первого аргумента по существу спора (см. ст. 4, п. 2 ст. 16 Закона о МКА).
