- заявление об отсутствии у состава арбитража права на рассмотрение спора, обычно основывается на аргументах о недействительности арбитражного соглашения, о том, что оно не распространяется на отношения между истцом и ответчиком (см. в частности assignment), не охватывает вынесенный на рассмотрение арбитража спор или о том, что право на обращение в арбитраж не возникло в связи с тем, что не исчерпаны доарбитражные методы урегулирования спора (см. multi-modal arbitration clauses'). Такое заявление также может быть обосновано аргументами о том, что состав арбитража сформирован ненадлежащим образом или предмет спора сам по себе не может быть объектом арбитражного разбирательства (см. arbitrable). В соответствии с нормой п. 2 ст. 16 Закона о МКА заявление об отсутствии у состава арбитража компетенции может быть сделано не позднее представления возражений по существу иска, сторона, не заявившая этого возражения своевременно, утрачивает право на осуществление такого заявления впоследствии, в том числе в ходе оспаривания или признания и приведения в исполнение арбитражного решения (см. ст. 4 Закона о МКА, estoppel). Назначение арбитра стороной, считающей арбитраж не управомоченным на рассмотрение данного спора, и участие ее представителей в ходе арбитражного разбирательства не приводят к утрате такой стороной права на заявление возражений против компетенции состава арбитража.
