partiality
= lack of independence - отсутствие независимости и/или беспристрастности арбитра. Доказывается только стороной, проигравшей арбитраж, так как в соответствии с п. 1 ст. V Нью-Йоркской конвенции и подп. 1) п. 2 ст. 34 и подп. 1) п. 1. ст. 36 Закона о МКА этот аргумент не может применяться по инициативе суда. Зависимость арбитров может послужить основанием для отмены арбитражного решения государственным судом по месту его вынесения (см. action to set aside) или для отказа в его признании и приведении в исполнение (см. подп. d) п. 1 ст. V Нью-Йоркской конвенции), а также для заявления отвода арбитру (см. challenge). См. также bias, impartiality of arbitrators, independence.
