- 1. в арбитражах, проводимых в соответствии с Арбитражным регламентом ЮНСИТРАЛ (UNCITRAL Arbitration Rules), компетентный орган, действующий на основании статей 6-8 и 12 указанного Регламента для решения вопросов о назначении и отводе арбитров. См. Рекомендации для оказания арбитражным судам и другим заинтересованным органам помощи в связи с арбитражным разбирательством, проводимым в соответствии с Арбитражным регламентом ЮНСИТРАЛ (Recommendations to assist arbitral institutions and other interested bodies with regard to arbitrations under the UNCITRAL Arbitration rules), опубликованные в Yearbook of the United Nations Commission on International Trade Law, 1982, Volume XIII. P. 420 и доступные на русском языке на сайте www.uncitral.org, а также Stockholm Chamber of Commerce Procedures and Services under UNCITRAL Arbitration Rules, www.chamber.se и Правила по оказанию содействия МКАС при ТПП РФ арбитражу в соответствии с Арбитражным регламентом ЮНСИТРАЛ, www.tpprf-mkac.ru; 2. в других арбитражах ad hoc, если стороны самостоятельно не согласовали орган, осуществляющий назначение арбитров и решающий вопросы об их отводе, как правило, нормы права, регулирующего проведение арбитража (lex arbitri), наделяют соответствующими функциями государственные суды по месту проведения арбитражного азбирательства. В России на основании норм п. 1 ст. 6 Закона о МКА такие функции выполняются Президентом Торгово-промышленной палаты Российской Федерации.
