= zwingendes Recht (нем.) = droit impératif (франц.) - 1. норма права, зафиксированная в законе или судебном прецеденте (в системе обычного права), которая не может быть исключена соглашением сторон и в любом случае подлежит применению к правоотношению, если оно подчинено той системе права (applicable law), в которую такая норма входит; 2. = mandatory rule of law - сверхимперативная норма права, международный правовой принцип особой важности.
