= abus de droit (франц.) = Rechtsmissbrauch (нем.) - злоупотребление правом, концепция, предусматривающая для допустившего такое злоупотребление лица невыгодные последствия как в материально-правовом аспекте (отказ в защите права, основанного на злоупотреблении), так и в процессуальном контексте (отказ состава арбитража в рассмотрении аргументов, представленных с злоупотреблением, или утрата права на использование того или иного аргумента (см. estoppel)).
